297. APOLOGIES FOR ABSENCE received from Cllr Mrs Allen(away), Cllr Fox(unwell), Cllr Hume(unwell) and Cllr Mrs E Penn(moving house).  Cllr Mrs Pell moved acceptance of apologies and this was seconded by Cllr Munday.  Motion carried by unanimous vote.

298. 299. PUBLIC QUESTION TIME: a)  Mr Paul Wiseman asked if any information could be given about river levels in Halstead.  Cllr Mrs Diver said that Cllr Munday and Cllr Gronland had recently met with representative of the Environment Agency who said that further talks with the Mill Owner and with Halstead Town Council would take place to discuss the way forward. Mr Wiseman noted that weeds are growing, including some sapling trees, and that river bed was now an eyesore that detracted from the floral enhancement of the Town.  Cllr Munday noted that E.A. has said that the current wild life habitats were good.  Mr Tony Lidster asked that it be noted that although the E.A. has said that the levels are kept low to avoid flood risk, in his opinion there is significant flood risk further down the river due to incursion of weeds, trees and the amount of rubbish in the river bed.  He also asked if there was any information regarding the flood management site to the north of the Town.  Cllr Mrs Diver said that questions would be asked of E.A.  Cllr Mr Lidster went on to ask if there is any remedy against the number of 'Cars 4 Cash' advertisements that are parked around the Town.  He was told that as long as the advertising vehicles are taxed, road legal and parked appropriately there is no redress.  He was also told that Braintree DC are looking into the matter and their decision will be made known.  Mr Martin Walker noted that on the Oak Road development the number of affordable homes seems to have diminished against the original plans.  Cllr Mrs Pell noted that a letter has been written to Braintree DC who has given assurances that the number of affordable homes and also the Section 106 monies will be enforced against the whole site which is split into two phases.  Mr Ian Tinton asked if it was known where the 40 houses proposed by Greenfields PH would be built and it was said that announcements would be made in the future regarding this issue.

b) A presentation was given by David Wilson Homes (part of the Barrett Home Group) regarding Phase II of the Oak Road development.  It was said that 100 homes, including 3 affordable homes, would be built on this site with houses arranged to give safe travel and in small clusters.  Hedges and tree belt would be retained and reinforced where necessary.  A detention basin for water retention is planned as well as underground storage of drainage water.  There will be a play area and a convenience store on the site which is designed with people in mind. 
At this point Cllr Mrs Pell moved that Standing Orders be set aside to allow members of the public to ask questions.  This motion was seconded by Cllr Munday and carried by unanimous vote.
Pam Jones asked about road structure to the site and Mr Daw was concerned about the amount of heavy traffic that will occur with no link between Phase I and Phase II of the site. He stated that residents had had no consultation about the removal of hedges and was concerned at the lack of communication between developers and residents.  Cllr Gronland asked if both Bloor Homes and David Wilson Homes could confer regarding connection of services to the sites to avoid any repetition of road works.  He was assured that Bloor Homes would be arranging for service connections to both sites.  Cllr Mrs Diver urged that all residents should be kept informed of progress at all times.  Cllr Munday asked if heavy lorries would be parked on Oak Road awaiting deliveries and was told that they would all have access to the site and that Bloor Homes would be widening the Road by 31st October as approved by Braintree DC (the Management Plan is available to the public on Braintree DC website).  Mr Daw said that residents had been told that Oak Road would be closed for 7 days from 24th October and asked about access to his home during that time.  Cllr Mrs Pell said that she would obtain information and liaise with residents. Mr Tony Bishop said that he lives in Conies Farm which is on the narrow part of Oak Road which is not suitable for heavy traffic and asked if signage could be placed at the Tidings Hill junction to ensure that vans and lorries do not use this road.  Cllr Mrs Diver said that Halstead TC has applied for this area to be made a 'Quiet Lane' but as yet no decision has been made.

Cllr Mrs Pell proposed that Standing Orders be reinstated.  Motion was seconded by Cllr Munday and was agreed by unanimous vote.

Cllr Gronland asked who would own the allotment and it was said that Halstead TC would be given first 'refusal' on the site according to Section 106 agreement.  Cllr Munday asked about the 'pond' which he feared may become a dumping ground for rubbish citing Halstead Public Gardens as an instance for antisocial behaviour.  It was said that the site will be maintained by a Management Company for which the residents will pay.  It was said that the pond will have shallow sides and although water levels will fluctuate according to amounts of rainfall the depth of water would not be great.  Cllr Munday pressed the matter and asked if the area could be covered but was told that Essex CC had asked for it to be an open area and hopefully to become a haven for wild life.  Cllr Radley asked the time plan for works and was told that, dependent on planning, it was hoped that the site would be completed within 2 1/2 years.  Wilson Homes representatives advised that they will be looking to Halstead TC for suggestions to name the road into the site.

300. MINUTES  To approve the minutes of the meeting on 17th July 2017.  Cllr Mrs Pell advised that she had only received draft minutes.  Cllr Mrs Pell moved approval of the minutes.  This was seconded by Cllr Munday and carried with 1 abstention.

301. PLANNING APPLICATIONS In Cllr Hume's absence Vice Chair of Planning, Cllr Mrs Pell took the Chair for this part of the meeting but said that Cllr Hume's findings would be taken into account for each application.

16/02186/REM - Land south of Oak Road, Halstead. Application for approval of all matters reserved by Condition 2 of outline planning permission 14/01580/OUT (appearance, landscaping, layout and scale), for the development of 192 residential dwellings (including 30 no. affordable housing), convenience store, parking, structural planting and landscaping, informal public open space, children's play area, allotments, surface water attenuation and associated ancillary works. Cllr Mrs Pell noted that this application did not at present fall within the boundary of Halstead but with possible forthcoming consultations on boundary changes and with no comments being lodged by Greenstead Green Parish council it was important for Halstead TC to comment.  Cllr Pell said that Braintree DC would decide in the look and layout of the plans and that roadway matters would be under Essex CC Highways jurisdiction although Halstead TC should make comments and recommendations.  It was noted that objectors had raised concerns about ingress and egress from the site onto the main A131 road and some signage may be recommended at this location.  Concerns had also been raised about travel from Tidings Hill along the narrow part of Oak Road and it was suggested that some signage regarding prohibition of Heavy Goods Vehicles along this road would be necessary.  It was noted that Anglia Water and Essex CC Highways had noted that drainage was not adequate.  Cllr Mrs Pell also felt that a Travel Plan should be in place that enabled service buses to enter, turn around and leave the site to enable travel by public transport.  Cllr Pell felt that the proposed play equipment was not adequate and noted that there was no provision of equipment for differently abled children.  The convenience store design was not clear, it was said and also noted that the RSPB had asked for some bird boxes to be erected.  The matter of affordable housing with Greenfields PH and also shared housing schemes needs to be clarified.  Cllr Mrs Pell noted that some telegraph poles had recently been erected in Oak Road by British Telecom without consultation with residents and asked that underground provision of digital services be requested.  It was requested that Halstead TC write to Braintree DC to say that this was a deviation from conditions laid down.  Cllr Radley asked about Section 106 money and it was noted that this had been agreed for the whole site and that this will be paid by Bloor Homes.  Cllr Munday suggested that to avoid congestion in Oak Road with possible difficulties for emergency vehicle ingress some parking restrictions be made.  Cllr Mrs Pell said that a Traffic Management Plan must be in place and adhered to.  Cllr Munday also asked that drainage issues be checked to make sure they are adequate. Cllr Pell proposed that this application raised concerns about Highway issues, particularly in the narrow section of Oak Road and asked that this be given Quiet Lane designation; there are also concerns about drainage issues, services connections and particularly those of digital services which should be underground.  Concerns are also raised about play equipment and the travel plan.  This proposal was seconded by Cllr Gronland and was carried by unanimous vote.

Representatives from Wilson Homes and some residents left the meeting at this point.

17/01265/FUL - 16 High Street, Halstead, CO9 2AD - Continuation of works consisting of the addition of a steel commercial staircase leading up to the apartment above the ground floor and the installation to the front elevation. Cllr Mrs Pell proposed no objections to this application.  Proposal seconded by Cllr Mrs Diver and carried unanimously

17/01287/FUL - Land Adjacent 21 Sloe Hill, Halstead, CO9 1JT - Erection of 3no. detached dwellings with garages and accesses to Sloe Hill. Some concerns had been raised from houses opposite which are listed, historic buildings.  Cllr Mrs Diver proposed that there are no objections to this application but that concerns from residents opposite should be taken into consideration.  Proposal seconded by Cllr Mrs Dingle and carried with 2 abstentions.

Cllr Mrs Diver and Cllr Mrs Pell left the meeting at this point.  Cllr Munday took the Chair.

17/01284/FUL - 118 Tidings Hill, Halstead, CO9 1BL - Erection of single storey rear extension.  Cllr Munday proposed no objection to this application.  Proposal was seconded by Cllr Mrs Dingle and was carried unanimously.

Cllr Mrs Diver and Cllr Mrs Pell returned to the meeting.  Cllr Mrs Pell resumed Chair.

17/01310/FUL - Walnut Tree House, 9 Gardeners Road, Halstead, CO9 2JU - Erection of two bedroom dwelling with associated parking and landscaping.  Cllr Mrs Pell noted one objection regarding overlooking at this property and also about tree removal. It was noted that new dwelling will have shared access.  Cllr Mrs Diver proposed no objection to this application but asked that resident's objections be noted and that the legality of shared access be made clear.  Proposal was seconded by Cllr Radley and was carried with one abstention.

17/01307/FUL - 13 Holmes Road, Halstead, CO9 1NW - Erection of single storey front and rear extension.  Cllr Mrs Pell proposed no comment and no objection to this application and proposal was seconded by Cllr Gronland.  Proposal carried by unanimous vote.

17/01312/FUL - Public toilets, Chapel Street, Halstead, Essex - Change of use from toilet block to two lock-up shops of A1 usage.  Cllr Mrs Pell raised concerns about proposed parking area on land with known services underground and at entrance to main town car park and proposed that this be flagged up to Planning Officers.  Proposal noting these concerns was made by Cllr Mrs Dingle and seconded by Cllr Gronland.  Proposal carried by unanimous vote.

17/01373/ELD - 31 Colne Road, Halstead, CO9 2HT - Application for an Existing Lawful Development Certificate - Loft conversion and roof extension.  Cllr Mrs Pell proposed no objection to this application.  Proposal seconded by Cllr Gronland and carried unanimously.

1701366/FUL & 17/01367/LBC - Congregation House, Parsonage Street, Halstead CO9 2JW - installation of three roof lights.  Some concerns had been raised, but Cllr Mrs Pell proposed no objections to this applications and proposal was seconded by Cllr Mrs Dingle.  Proposal carried by unanimous vote.

17/01171/FUL - 30 Ozier Field, Halstead, CO9 1UX - Erection of single storey rear extension. Cllr Mrs Pell proposed no objection to this application and this was seconded by Cllr Mrs Diver.  Proposal was carried by unanimous vote.

Cllr Munday left the meeting at this point.

17/01359/FUL - 28 Ashlong Grove, Halstead, CO9 2QH - Erection of single storey front extension.  It was noted that 1 objection had been received asking for retention of flat roof.  Cllr Mrs Pell proposed no objection to this application.  Proposal seconded by Cllr Radley and carried by unanimous vote.

17/01405/FUL - 2 Bois Hall Gardens, Halstead, CO9 2HX - Erection of a single storey rear extension, alterations and pitched roof over existing garage. Cllr Mrs Pell proposed no objections to this proposal and this was seconded by Cllr Munday.  Proposal was carried by unanimous vote.

17/01290/FUL - 34 Trinity Street, Halstead, Essex, CO9 1JA.  Demolition of existing outbuilding and erection of commercial building to be used as an extension to existing business Jenniz Beauty Salon.  Cllr Mrs Pell proposed no objections to this application and this was seconded by Cllr Munday.  Vote for this proposal was unanimous

17/01401/FUL - 33 Winston Way, Halstead, CO9 2TH - Amendment to previous approval reference 17/00205/FUL - Change to the first floor external facade from render to front with brick to side and rear to cedral clad to first floor to extension walls only.   Cllr Mrs Pell proposed no objection to this application and this was seconded by Cllr Gronland.  Vote was unanimous for this proposal.

17/01390/FUL - Wash Farm Barn, Hedingham Road, Halstead, CO9 2DW - Erection of cart lodge.  Cllr Mrs Pell proposed no objection to this application and this was seconded by Cllr Radley.  Proposal was carried unanimously.

Cllr Munday returned to the meeting.

17/01418/FUL & 17/01419/LBC - 7A High Street, Halstead, CO9 2AA. Change of use of the first floor to residential and renovation of the second floor to provide two residential units.

It was noted that some environmental health conditions had been raised.  Cllr Mrs Pell proposed no objections to this application.  This proposal was seconded by Cllr Mrs Diver and carried by unanimous proposal. 

Cllr Mrs Pell moved that this meeting be closed to enable planning applications on the agenda for second meeting of the evening to be taken at this point. 

Cllr Mrs Diver resumed Chair of the meeting and suspended the agenda for first meeting at 8.36p.m.

It was proposed by Cllr Munday that the Extraordinary Planning Meeting scheduled for the evening be opened;  this was seconded by Cllr Gronland and carried unanimously.

 302.  Apologies for the Extraordinary Planning Meeting were received from Cllr Mrs Allen, Cllr Fox, Cllr Hume and Cllr Mrs Penn.  These apologies were moved by Cllr Mrs Pell and seconded by Cllr Munday.  Apologies for absence accepted unanimously. 

303.  Declarations of Interests were accepted as at previous meeting.

304.  PUBLIC  QUESTION  TIME.  Ms Helen Woolf commented on the planning application 17/01432/FUL - Halstead Police Station and lodged concerns that the historical significance of this building had not been adequately taken into consideration.

305.  PLANNING  APPLICATIONS.  Cllr Mrs Pell Vice Chair of Planning took the Chair for this part of the meeting but noted that the comments by Chair of Planning, Cllr Hume would be taken into consideration for each application.

17/01432/FUL - Halstead police Station, Trinity Street, Halstead, CO9 1JG - Change of use from Halstead's Police Station ~ (Sui Generis) TO 5 residential apartments (C3).  Cllr Mrs Pell noted that pre-planning advice had been taken but raised concerns about the plan for bin storage at the front of this listed building.  Concerns were also raised about the number of 5 off street parking spaces provided which, it was suggested, is not adequate for the potential number of residents on this site.  Cllr Radley proposed that Council object to this application on grounds of overdevelopment and inadequate parking provision.  This proposal was seconded by Cllr Gronland and carried by unanimous vote.

17/01472/FUL - 10 Mount Hill, Halstead, CO9 1AF - Erection of two-storey side and rear extension.  Cllr Mrs Pell proposed no objections to this application and this was seconded by Cllr Munday.  Proposal was carried by unanimous vote.

17/01473/FUL - 73 Windmill Road, Halstead, CO9 1LN. - Erection of two-storey side extension.  Cllr Mrs Pell noted that this Council objected to the quality of the plans provided but raised no objections to the application.  Proposal was seconded by Cllr Mrs Diver and carried by unanimous vote.

17/01456/FUL - 15 Evans Court, Halstead, CO9 2GE - Retention of trellis to an existing brick wall.  It was noted that a similar application had been previously lodged but that this application had addressed some issues raised by Essex CC Historical Buildings Dept.  Cllr Mrs Pell proposed no objections to this application and this was seconded by Cllr Mrs Dingle.  Proposal carried by unanimous vote.

Cllr Gronland suggested that in future the Chair and Vice Chair of Planning meet with him and perhaps another Councillor to sort planning applications before meetings and bring block proposals to Council.  Chairman said that this idea had been previously mooted and that some consideration would be given to this suggestion. 

306.  EXCLUSION OF PUBLIC AND PRESS.  To give consideration to adopting the following resolution: 'that in view of the confidential nature of the business about to be transacted and pursuant to the provisions of section 1(2)- of the Public Bodies (Admission to Meetings) Act 1960, as amended, the public and the press be temporarily excluded from the meeting'

There were no confidential matters to discuss.

There being no other business the meeting was closed at 8.38p.m.

Cllr Mrs Pell moved that the previous meeting be re-opened.  This proposal was seconded by Cllr Munday and the vote was unanimous.


307.  Agenda item 6. MAYOR'S APPOINTMENTS AND ANNOUNCEMENTS.  Report was available and it was noted that Mayor was not able to attend the visit to Little Havens Hospice on 14th September as she would be attending the Anglia in Bloom Awards.  Vice Chairman was not able to attend in her place.  Letter outlining this position would be written. Report noted.

308.  FINANCE. Cllr Radley Chair of Finance took the Chair for this part of the meeting.

7a Finance.  Chairman noted income for car parks and permits was in excess of budget as some bulk permits had been sent and income received.  Lettings at Queen's Hall and Mill House were both down on schedule and income and expenditure on Outings was also reduced.  Expenditure was also on budget and there had been no drawings on Earmarked Reserves.  Capital Reserves showed expenditure on Queen's Hall conversion which was on schedule.  Cllr Radley proposed acceptance of this report.  Proposal was seconded by Cllr Munday and proposal was unanimously accepted.

7b. Payments to be approved.  Chairman noted no abnormal payments and Proposed that this report be accepted.  Proposal was seconded by Cllr Dingle and vote was unanimous.

7c. Accounting Practices.  Report detailed the accounting practices flagged up by Internal Audit Report as being in need of re-evaluation.  Some work had been done to develop the Sage reporting system and some training using Webinars had been undertaken.  More training will be done and staff are supporting the moves to better accounting practice.  Cllr Radley, Town Clerk and Staff were congratulated and thanked for their efforts, particularly as this was a zero cost option.  Acceptance of this report was proposed by Cllr Radley and seconded by Cllr Gronland.  Vote for acceptance was unanimous.

7d. CIF application for funding for the demountable stage at Queen's Hall.  Cllr Radley noted that it was now time to lodge expressions of interest for funding for this item and it has been suggested that a grant of about £7000 be sought with Halstead TC offering matched funding of £1000.  This would be put into budget for next financial year 2018/19.  Storage of a demountable stage was said to be possible and it was queried whether hirers would be charged extra for use of this stage.  To be discussed in the future.  Town Clerk said that grant bids would need to be lodged by September.  Cllr Radley proposed that expression of interest in obtaining funds from a CIF grant be made.  This proposal was seconded by Cllr Munday and adopted by unanimous vote.

309.  COMMUNITY  HALL  No report was given, but it was said that some Councillors had visited Gamlingay to see their Community Hall and had found the information given regarding management by the Trust at Gamlingay rather than by the Council, very interesting and constructive.

310.  YOUTH.  No report

311.  DISTRICT  COUNCILLORS.  Cllr Mrs Pell said that few meetings had taken place during the summer holiday period.  Licensing Committee meeting had been postponed but a meeting had taken place with the Hackney Carriage members. Cllr Mrs Pell had undertaken some member development training which had been of interest.  Braintree DC at general meeting had noted a Highways consultation regarding improvements to Halstead Town Centre.  Matters regarding upgrade of A131/A120 road were moving forward and a by-pass for Sudbury had again been mentioned; talks were taking place with Essex CC and Braintree DC.  A meeting had taken place with Barclays but there was nothing to report about this. Police and Crime Commissioner would be holding a public meeting in Halstead, and posters advertising this are on notice boards.  Date for next Cabinet meeting has been changed.  Andy Wright has taken up his post as Chief Executive Officer.

312.  GREENFIELDS COMMUNITY  SITE  AT  CHERRY  TREE  CLOSE - Naming of Road.  Greenfields PH have acquired a site at Cherry Tree Close and have asked for suggestions to name the site. Cllr Radley suggested Alder Close and this proposal was seconded by Cllr Munday.  Proposal was adopted with 1 abstention.

313.  OUTDOOR GYM  AT  RAMSEY  ROAD.  It was agreed that some of the Section 106 monies had been earmarked for this project and Councillors expressed frustration at the delay in provision.  Braintree DC have said there must be public consultation and that this will not take place until after 1st April 2018.  This provision had been identified as desirable at the recent Town consultation and an Open Spaces budget of over £50K had not yet been spent.  Cllr Mrs Diver noted that this is a deprived area and Cllr Mrs Pell suggested the course of action should be firstly to write to Braintree DC Chief Executive privately noting Council's frustration and secondly to go to Public Question Time at Braintree DC to ask when money would be available.  Cllr Mrs Pell advised against alienation of the Officers and Councillors and asked that Members be kept informed of outcomes. Report was noted.

QUEEN'S HALL  PROGRESS  REPORT.  Town Clerk reported that conversions are going well and that some free assistance with painting and decorating had been given by community service volunteers.  The kitchen is well on the way to completion and work is on schedule for re-opening the hall at beginning of September.   It was suggested that there should be an 'opening day' event to showcase work done and that the Hall be marketed widely.  Cllr Munday noted the cost savings with groundsmen enthusiastically getting involved.  It was reported that the History Society plans are moving forward and it was hoped that Council will move into the premises sometime in October.  Report was noted.

315.  RETURN TO  NAMING  OF THE DEVELOPMENT ADJACENT TO 85 COLCHESTER ROAD.  It was noted that Council had made a decision on this naming at July meeting and McDowell was the preferred name.  Councillors saw no reason to change their stance on this and Cllr Mrs Diver proposed that Regent Square Developments be appraised of this decision.  Proposal was seconded by Cllr Munday and unanimously adopted.

316.  BRAINTREE ASSOCIATION OF LOCAL  COUNCILS  AGM.  Cllr Gronland attended the meeting and said that minutes will be circulated when available.  Cllr Gronland said that there is much information to be gained from BALC and there could be investigation on how this can be better utilised by this Council.  Cllr Mrs Pell proposed that report be noted and this proposal was seconded by Cllr Mrs Dingle.  Vote for adoption was unanimous.

317.  EXCLUSION  OF  PUBLIC  AND  PRESS.  To give consideration to adopting the following resolution: 'that in view of the confidential nature of the business about to be transacted and pursuant to the provisions of section 1(2)- of the Public Bodies (Admission to Meetings) Act 1960, as amended, the public and the press be temporarily excluded from the meeting'

Cllr Mrs Diver moved standing orders to allow a further 25 minutes time for the meeting.  This proposal was seconded by Cllr Munday and the vote was unanimous.

318.  QUEEN'S  HALL  PROJECT - APPOINTMENT  OF CONTRACTOR.

The meeting agreed the awarding of further contracts for the completion of works at Queens Hall, including . This was proposed by Cllr Mrs Diver and seconded by Cllr Mrs Dingle. The vote was unanimous.
